  2. APPLICATION OF TERMS

    2.1 You may use this Website providing you agree to these Terms. If you do not agree to these Terms, you must not use this Website. If you use the Website, you will be deemed to have accepted these Terms.
    2.2 We reserve the right to change these Terms by posting any changes on the Website. The new Terms will be effective as soon as they are posted.
    2.3 You agree and acknowledge that we may suspend or terminate your account at anytime and without further notice to you if, in our reasonable opinion, your use of the Website is inconsistent with these Terms.

  3. POSTING REVIEWS

    3.1 The Company allows you to post a review (“the Review”) in the form of an opinion about:
    3.1.1 rental properties in the United Kingdom; and/or
    3.1.2 landlords of the applicable rental properties;
    PROVIDED THAT you have lived in the applicable rental properties for not less than [4 weeks] in the period of 2 years immediately preceding the date of your posting.
    3.2 Before posting a Review or reading Reviews posted by other users on the Website, you will need to register for an account with us.  You will not need to register for an account if you only wish to search for Reviews and read thumbnail extracts of such Reviews.
    3.3 Information which you give us as part of the registration process will be used and stored in accordance with our Privacy Policy.  For details of the Policy, please click here.
    3.4 You warrant that the information which you provide us is true, accurate and complete.
    3.5 During the registration process, users will be asked to select a unique ID and password (together the “User ID”) for using the Website.
    3.6 The Company does not, at present, charge any fees for posting or reading Reviews on the Website, but we reserve the right to do so in the future.
    3.7 Reviews are retained on the Website for a reasonable period of time, subject always to the provisions of Clause 7.
    3.8 Users are not permitted to edit or delete any Reviews once posted.

  4. LICENCE

    4.1 Copyright in your Review will belong to you.
    4.2 By posting a Review on this Website, you grant the Company a royalty-free, non-exclusive and perpetual licence to:
    4.2.1 display or reproduce the Review on the Website;
    4.2.2 remove your Review from the Website pursuant to Clause 7; and
    4.2.3 disclose your Review to any third party if such disclosure is required:
    4.2.3.1 by law;
    4.2.3.2 to enforce our rights against you;
    4.2.3.3 to enable us to respond to any claims that the Review infringes the rights of any third party; and
    4.2.3.4 to protect other users of the Website or the public in general.

  5. YOUR RESPONSIBILITIES

    By using this Website, you agree:
    5.1 to use the Website for lawful purposes;
    5.2 to accept full responsibility for any Review which you post on the Website;
    5.3 that the content of any Review which you post will not contain any defamatory, offensive, threatening, abusive, racist, vulgar, obscene, profane, indecent, hateful or any otherwise objectionable material or post any Review that is intended to annoy, harass or intimidate another person or post a Review that will constitute a criminal offence or give rise to a civil liability;
    5.4 that the Website is for your personal use only;
    5.5 not to use the Website to solicit other users to become users of competitive online services, or to advertise or offer to sell any goods or services, or promote any surveys, contests or chain letters for any commercial purpose;
    5.6 not to post or make available any material which is protected by copyright, trademark, or other proprietary right on the Website without the express permission of the owner of the copyright, trademark, or other proprietary right and you will be solely liable for any damages resulting from any infringement of any such copyrights, proprietary rights, or any other harm resulting from any uploading, posting, or submission to the Website;
    5.7 not to upload files to the Website that contain viruses, corrupt files, or other similar software or programs that may damage the operation of the Website or another person’s computer, software, website, or network and you will be solely responsible for any damages from any claims that may arise because you posted files that caused damage to the operation of another person’s computer, software, websites, or network;
    5.8 not to impersonate any person or entity, or otherwise misrepresent your affiliation with such person or entity;
    5.9 not to collect personal data about other users; and
    5.10 to be responsible for ensuring and maintaining the confidentiality of your User ID.

  6. COMPLAINTS ABOUT REVIEWS POSTED ON THE WEBSITE

    6.1 You agree and acknowledge that we do not pre-screen or filter Reviews before they are posted on the Website.
    6.2 If you discover any Review that has been posted on the Website that breaches any of these Terms, you are requested to notify us immediately. Please set out the following in your notice:-
    6.2.1 the full details of your complaint including, but not limited to, the reasons for your complaint; and
    6.2.2 any action you request us to take in relation to the subject matter of your complaint.
    6.3 Please note that we will deal with the matter as we see fit, but will take your views into consideration.
    6.4 You can write to us at our e-mail address given in Clause 1 above or send us a message using our Contact Page on the Website.

  7. REMOVAL OF REVIEWS

    If we are notified that a Review posted on the Website infringes the rights of others or the conditions set out in these Terms, we:
    7.1 reserve the right, in our sole discretion, to remove any Review submitted to, or posted on the Website without giving a reason;
    7.2 may investigate any allegation made by any person about any Review posted on the Website and shall decide, in good faith at our sole discretion, whether to remove any Review posted on the Website; and
    7.3 have the right, but not the obligation, to monitor the content of the Website to ensure that these Terms are being complied with.

  8. INTELLECTUAL PROPERTY

    Our Website and all of the related pages, including not limited to content, software, code, graphics or other material contained either in the sponsor advertisements or electronically distributed on the Website is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Unauthorised use of any copyrighted materials, trademarks or any other intellectual property without the expressed written consent of the Company (or sponsor, as applicable) is strictly prohibited.

  9. INDEMNITY

    You agree to indemnify and keep indemnified us, our successors and assigns, our directors, officers, employees and agents from and against all liabilities, claims, losses, costs, damages and expenses including legal fees which are reasonably incurred by us, as a result of your acts or omissions in breach of these Terms or in breach of English Law.

  10. WARRANTIES

    10.1 We do not give any warranty, condition, guarantee or representation, express or implied, relating to information or Reviews contained on the Website or to any website to which it is linked.
    10.2 We do not warrant that our Website will be free of error or that the Website and the server are free of computer viruses or other harmful applications.

  11. DEALINGS WITH ADVERTISERS OR PARTNERS

    Any correspondence or business dealings with, or participation in the promotions of, any advertisers or partners found through or on the Website, are solely between you and such advertiser or partner.  The Company shall not be responsible for any loss, damages, liabilities or expenses which you may incur or suffer as a result of such correspondence or dealings.

  12. LINKS TO THIRD PARTY SITES

    We may, from time to time, provide links to third party sites. The linked sites are not under our control and we explicitly state that we are not responsible for the contents of any linked site. The links are provided for your convenience and any such link does not imply endorsement by us of the site or of any association with the operators of the site.

  13. LIMITATION OF LIABILITY

    13.1 We shall not be liable to you (except in respect of injury or death of any person for which no limit applies under English Law) regardless of the form of action, whether in contract, tort (including negligence and breach of statutory duty) or otherwise whatsoever, for any loss of profit, business, contracts, or revenues, or for any special, indirect or consequential damage of any nature whatsoever arising directly or indirectly out of your use of our Website or your reliance on the Reviews posted on the Website.

    13.3 If you enter our Website, you agree that this Clause 13 relating to limitation of liability is reasonable and it reflects the nature of the Website.

  14. SEVERANCE

    If any term is held to be invalid, unlawful or unenforceable, it shall not affect the enforceability of any of the remaining terms.
